  2. You Are Art may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by You Are Art. Your continued use of You Are Art.co.uk after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

Ownership of the site

  1. This site is owned and operated by Loxham Limited (referred to herein as 'Loxham Limited,' 'we,' and 'our'). All content included on our site, such as prints, photographs, illustrations, images, text (referred to as 'Content') is owned by Loxham Limited or our content providers. All Content is protected by English and International copyright laws. For the protection of Loxham Limited and our content providers, images may be watermarked.
  2. You may not copy, reproduce, republish, download, post, broadcast, transmit or otherwise use the content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any content except for your own personal, non-commercial use. Any other use of You Are Art content requires the prior written permission of Loxham Limited or relevant copyright owners.
  3. Images of people or places displayed on this site are either the property of Loxham Limited, or used with permission of the copyright owner. The use of these images by you, or anyone else authorised by you, is prohibited unless specifically permitted by these Terms & Conditions or specific permission provided elsewhere on the Site. Pictures sent to You Are Art

It is solely and without exception the responsibility of the person sending pictures to the site to ensure that they have the permission of the copyright owner to use the image.

By sending your picture to You Are Art.co.uk you warrant that:

  1. it is your own original work or that you have the written permission of the copyright owner and that you have the right to make it available to Loxham Limited for all the purposes specified above;
  2. it does not infringe any law; and
  3. you indemnify Loxham Limited against all legal fees, damages and other expenses that may be incurred by Loxham Limited as a result of your breach of the above warranty; and
  4. you waive any moral rights in your contribution for the purposes of its submission to and publication on the site and the purposes specified above.

Colour reproduction

Exactly how you personally see the colours on your screen will depend on a number of things including, but not exclusively; how the room is lit, the colour settings on your computer, the make of and model of your screen, the make and model of the graphics card you have, the age of the screen and if it is a Mac or a PC. As you can see this is quite a list, so the exact colour you see may be a little different from that which we see, and which in turn is printed.

Our concern is to produce the very best image we can for you and whilst this process should normally result in a pretty close match to what you see on screen, it may not be exactly as you see it.

Please note also that we cannot match the colours of existing photographic prints you may have. Printing on photographic paper involves a different printing process onto a different type of paper and the resulting colour balance is different.

Portraits produced by You Are Art

The copyright of all portraits produced by You Are Art remains with the company. Portraits may not be reproduced without written permission of the copyright holder. Any unauthorised use of the images by anyone other than the company may violate Copyright Laws, Trademark Laws, the laws of privacy and publicity, and communications regulations and statutes.

The company may reproduce and distribute them as they see fit. In practice this will normally mean just showing them as examples of their work on the web site and in marketing material, but may extend to reproducing the image in other media.

Cancellation/ Refund Policy

Photos on Canvas
Every piece of artwork ordered through this site is bespoke and created for you. This means that once the canvas has been printed we are not able to offer you a refund or a cancellation. However this does not affect your statutory rights.

Portraits
Every piece of artwork ordered through this site is bespoke and created for you. If you would like to cancel the order prior to the artist starting work - if for example you couldn�t find a photo that the artist could really work with - we would refund the 50% payment. Once we have agreed the style, composition and colour scheme you want to see at the draft stage and the artist has started work, we are unable to refund the 50% payment.

Please note that the finished canvas will not be despatched until the second 50% payment is made

Payment

All prices are inclusive of VAT (where applicable) and are correct at the time of entering the information onto our database. The total cost of your order is the price of products ordered plus delivery charges as stated upon the website.

For all orders received for shipment beyond the boundaries of the European Union; any applicable duties for the import of products into chosen countries from the UK are the responsibility of you, the ordering customer.

Payment can be made by any of the methods specified in the payment section of this website. By placing an order, you confirm that the credit or debit card that is being used is your own, or is being used with full authorisation of the card holder.

All credit and debit card holders will be subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to us we will not be able to process your order, nor will we be liable for any delay or non-delivery of product(s) as a result.

Refusal of Transaction

We reserve the right to withdraw any products from this website at any time. We may refuse to process any transaction for any reason or refuse service to you at our sole discretion.

To be eligible to purchase products on this website and lawfully enter into contracts under English law you must:
